    1. Introduction

    Welcome to QBitFlow. These Terms of Service ("Terms") govern your access to and use of the QBitFlow platform, including any associated mobile applications, websites, software, and services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

    2. Definitions

    • "QBitFlow" refers to the company operating the Services.
    • "User" refers to any individual or entity that accesses or uses the Services.
    • "Merchant" refers to any User that uses the Services to accept cryptocurrency payments.
    • "Customer" refers to any User that makes payments through the Services.
    • "Cryptocurrency" refers to digital currencies, including but not limited to Bitcoin, Ethereum, Solana, and stablecoins like USDC.

    3. Account Registration and Requirements

    To use certain features of the Services, you must create an account. When you create an account, you agree to:

    • Provide accurate, current, and complete information.
    • Maintain and promptly update your account information.
    • Maintain the security of your account, including keeping your password confidential.
    • Notify QBitFlow immediately of any unauthorized use of your account or any other breach of security.
    • Accept responsibility for all activities that occur under your account.

    Age Requirement

    You must be at least 18 years old to create an account and use the Services. By creating an account, you represent and warrant that you are at least 18 years old.

    4. Service Description

    QBitFlow provides a non-custodial cryptocurrency payment processing platform that allows Merchants to accept cryptocurrency payments and manage subscriptions through smart contracts. The Services include:

    • Processing cryptocurrency payments.
    • Managing subscription billing through smart contracts.
    • Providing analytics and reporting tools.
    • Offering API access for integration with third-party services.

    5. Fees and Payment

    QBitFlow charges fees for the use of the Services as described on our pricing page. By using the Services, you agree to pay all applicable fees. QBitFlow reserves the right to change the fees at any time, with notice to Users.

    Non-Custodial Service

    QBitFlow operates as a non-custodial service, meaning we do not hold or control your cryptocurrency. Payments are processed directly between the Customer and the Merchant through smart contracts.

    6. User Obligations

    As a User of the Services, you agree to:

    • Comply with all applicable laws and regulations.
    • Not use the Services for any illegal or unauthorized purpose.
    • Not attempt to circumvent any security features of the Services.
    • Not interfere with the proper operation of the Services.
    • Not engage in any activity that could harm or disrupt the Services or other Users.

    7. Intellectual Property

    The Services and all content, features, and functionality thereof, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are owned by QBitFlow or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

    8. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, QBitFlow SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

    9. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which QBitFlow is established, without regard to its conflict of law provisions.

    10. Changes to Terms

    QBitFlow reserves the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on the Services or by sending you an email. Your continued use of the Services after such modifications will constitute your acknowledgment of the modified Terms and agreement to be bound by them.
